Information on powers of attorney

What is a power of attorney

A power of attorney is a legal document by which a person (the principal) authorises another person (the representative) to act on their behalf in specific matters. The power of attorney must be provided in written form and signed by the principal. There are general and special powers of attorney.

General vs. Specialised

A general power of attorney grants the representative very extensive rights and can be used for all matters. A special power of attorney is limited to specific matters (e.g., sale of an apartment, representation in court). A special power of attorney is safer.

Verification

Some powers of attorney require notarisation or verification against a signature. Examples include powers of attorney for court representation, real estate transactions, or international representation. Verification increases the legal weight of the document.

Cancellation

The owner may revoke the power of attorney at any time. The revocation must be notified to the representative and all persons who were aware of the power of attorney. The power of attorney is also automatically revoked upon the death of the owner or the representative.
